Workshop On Finding An Effective Approach Of Public – Private Partnership In Expressway Bot Projects In Vietnam

In the light of promoting for the Public – Private Partnership and in particular drawing attention on difficult issues in the process of infrastructure development through the BOT model, the Vietnam International Arbitration Center (VIAC) in collaboration with VCCI and the United States Agency for International Development (USAID) organized a workshop “Finding an effective approach of PPP in Expressways BOT Projects in Vietnam” in Hanoi on 21 June 2022. 
                                         
The workshop is chaired by Doctor Vu Tien Loc, President of VIAC, with participation from key speakers in the sector:  Ms Vu Quynh Le – representative of the Department of Procurement Management of the Ministry of Planning and Investment; Mr Le Bach Cuong, Head of Legal & Procurement Division, Transport engineering construction and Quality management Bureau of Ministry of Transportation; Mr Tran Chung, the President of Vietnam Association of Road System Investors; Mr Tran Tuan Phong, Partner at VILAF LLC; Mr Duong Dang Hue, former Director General of Department of Economic Civil Legislation, Ministry of Justice; Mr Doan Tien Giang, PPP Expert, AEO Project, U. S. Agency for Investment Development (USAID) and Mr Nguyen Hai Minh – Vice Chair of EuroCham.
                           
For the whole morning, the speakers shared the evaluation on the State’s policy on BOT model in infrastructure construction and operation, the overview of Draft BOT model contract in transportation infrastructure, and the opinion on practice in Vietnam and international experience on BOT model. Experts have brought forward many recommendations to troubleshoot and solve current problems in PPP regulations towards an effective legal environment to attract more foreign investors in infrastructure projects. Representing EuroCham, Mr Nguyen Hai Minh informed the audience with the latest updates of the European investment in Vietnam, their expectation on the investment and legal environment, especially in infrastructure projects, as well as the concerns from EU investors perspectives on the current regulations on PPP.
                            
Closing the workshop, Mr. Loc shared that though the Law on PPP has been passed and effective as from Jan 2021, there remain obstacles in the long run. These barriers lie in not only delayed process created by legislation and administration procedures but also the complicated operation of managing bodies. Therefore, VIAC will continue to coordinate with related agencies to have further dialogues on idea exchanges in order to enhance and foster an effective implementation.
