Ministry of Health Disseminates New Food Safety Regulations

On 2 February 2026, the Ministry of Health hosted a conference to disseminate Decree No. 46/2026/ND-CP and Resolution No. 66.13/2026/NQ-CP, aimed at implementing and providing guidance on new regulations in the field of food safety. Representing EuroCham’s Nutritional Foods Group (NFG) was Head of Technical Working Group Tran Hong Uy and Member Nguyen Ngoc Hoan.

Details of the new Decree and Resolution

Held in a hybrid format, the conference gathered provincial and municipal People’s Committees and Departments of Health, along with delegates nationwide. The Food Safety Authority briefed all delegates on:

  • Decree No. 46/2026/ND-CP dated 26 January 2026, detailing the implementation of several articles and measures for the Law on Food Safety’s enforcement;
  • Resolution No. 66.13/2026/NQ-CP dated 27 January 2026, on food product self-declaration and registration.

The conference also included dedicated discussion sessions to address practical challenges to support consistent understanding and effective implementation at both central and local levels.

In his concluding remarks, Deputy Minister of Health Do Xuan Tuyen underscored three key priorities under Decree No. 46/2026/ND-CP and Resolution No. 66.13/2026/NQ-CP:

  • Administrative reform: simplifying procedures related to food advertising, testing facility designation, and imported food inspections to reduce processing time and compliance costs for businesses.
  • Stronger decentralisation: transferring 31 of 39 food safety administrative procedures to local authorities to improve efficiency and responsiveness.
  • Enhanced supply chain oversight: strengthening end-to-end control from production to consumption, combining pre- and post-market inspections, increasing business legal accountability, and tackling counterfeit food and misleading advertising.

Noting the more facilitative approach introduced under the new regulations, the Deputy Minister encouraged ministries, sectors, and local authorities to provide clear guidance to support compliant and effective implementation by businesses and stakeholders.

These updates signal a more facilitative environment for companies in Vietnam’s food sector, with streamlined procedures and greater decentralisation expected to reduce compliance burdens and speed up administrative processes. At the same time, stronger supply chain oversight supports fair competition, enhances consumer trust, and contributes to a more stable and transparent market environment.
